STATE CONSTITUTIONAL LEGAL CHALLENGE TO NEW YORK'S RELIGIOUS LIBERTY REPEAL LAW TO BE HEARD MONDAY SEPTEMBER 30TH IN STEUBEN COUNTY

The state constitutional legal challenge brought by lead Attorney James Mermigis, Elizabeth Brehm and Kevin Barry will be heard before Honorable Judge Robert B. Wiggins in Steuben County Supreme Court in Bath, NY at 10:30AM on Monday, September 30, 2019.
On June 13, 2019, 20 million New Yorkers had a religious liberty stripped from them by the Legislature and Governor Cuomo after a highly irregular vote in which a 13-13 tie (defeating the bill) was changed to a 14-12 vote. As a result, 26,000 New York school children lost their religious exemption to vaccination and can no longer attend school. Healthy children belong in school.
The repeal of the religious exemption violates Article 1, Section 3 of the New York State Constitution (1777), which provides broader protection of religious liberty than the First Amendment (1789) to the US Constitution.
We are requesting that if the Preliminary Injunction (also known as a "stay') is granted in this case that it will be applied to all New Yorkers. Plaintiff Jocelyn Sullivan-Knapp resides in Steuben County. She has two children - ages 13 and 8 - who have been removed from school due to their family's religious beliefs.
